The following is a summary of the Fonds' practices of Protection of Personal Information.[1]

The information we collect and how we use it

We collect your name, address, e-mail address, age, and financial and tax information to validate your eligibility for our products and services, to manage your files, to evaluate your application, to verify your identity, and to prevent and detect fraud.

The Fonds may also collect information when you visit our websites, including the identifier of the computer equipment you use (IP address), in order to communicate targeted advertising and surveys.

Your consent

The Fonds aims to be transparent and to clearly inform you at the time of collection of the uses that will be made of your personal information, the means by which it is obtained if it is not collected directly from you, your rights as well as the categories of third parties to whom it may be communicated and the possibility that it may be communicated outside Quebec, if applicable, so that your consent is manifest, free and informed.

You may withdraw your consent to the use of your personal information for purposes that are not essential to the management and administration of your products and services, such as providing you with targeted advertising and surveys and also to customize your experience.

Safety

While the Fonds maintains security measures to protect your personal information and reduce the risks of breach, a risk remains, and we cannot provide 100 % assurance that your personal information will not be breached in the event of a breach of our security measures. If you have reason to believe that personal information has been compromised, please contact the Office of the Chief Privacy Officer.

Your rights

You can view the personal information that the Fonds has collected on you, verify its accuracy, and amend it, if necessary, file a complaint if you are not satisfied with the handling of your personal information by sending your request to the Chief Privacy Officer, whose contact information is reproduced below.

1. Why this opinion?

This Protection of Personal Information Notice (the "Notice") describes the privacy policies and practices that the Fonds de solidarité des travailleurs du Québec (F.T.Q.) and its subsidiaries, the FlexiFonds de solidarité FTQ Inc., the Fonds locaux de solidarité FTQ, the Fonds régionaux de solidarité FTQ, the Fonds immobilier de solidarité FTQ and the Fonds de solidarité FTQ Bioénergie (collectively, the "Fonds")[2] undertake to apply in the course of their activities.

2. Who is this notice for?

    • Investors and unitholders of the Fonds and potential investors and unitholders;
    • The candidates for the position of director on the boards of the Fonds' partner companies;
    • Candidates for employment with the Fonds, for the position of director or member of the Fonds' boards of directors or committees, and candidates for the position of local representative of the Fonds;
    • Users of the Fonds website or application to the extent that personal information is collected;
    • Any individual who communicates with the Fonds, participates in contests or events organized by the Fonds, or whose personal information is collected or processed in connection with the Fonds's activities.

3. What personal information do we collect?

The Fonds only collects personal information that is necessary for the purposes of its activities, including information relating to your identity, such as your name, address, social insurance number, demographic information, such as your gender, age, tax information, financial information, such as shareholdings, assets, income, as well as information relating to the use of its Web sites, such as your IP address, location or navigation data.

4. Why are we collecting your personal information?

The Fonds collects, uses, and discloses your personal information for the purposes for which you consent or that are permitted by law. The purposes for which the Fonds collects your personal information are specified at the time of collection, for example, when applying for membership. You can ask us for more details about these uses at any time.

    • Check if you are eligible for our products and services;
    • Confirm your identity and verify the accuracy of your personal information;
    • Process and administer your file;
    • Provide financial advice and guidance;
    • Generate statistics and analyze data;
    • Formulate and communicate targeted advertisements;
    • Send personalized communications, recognition and gifts;
    • Apply to take part in competitions or events organized by the Fonds;
    • Assess your candidacy and retain the results of the evaluation of your candidacy for future reference, if applicable;
    • To manage our websites and online services, and to personalize and tailor the browsing experience to your needs;
    • Communicate with you;
    • Meet our legal and regulatory requirements and prevent fraud.

5. How is your personal information collected?

Directly to you

    • Contact us (in person at a point of service, by phone, email, etc.);
    • Subscribe to the Fonds's products and services;
    • Make specific requests to the Fonds (additional purchase, redemption request, etc.)
    • Submit an application for financing;
    • Comment on our website or complete surveys.

With third parties

The Fonds may also collect your personal information from third parties with your consent or if it is authorized by law to do so.

6. Does the Fonds collect information about me through cookies on its Web sites?

If you accept them when accessing the Fonds's websites (hereinafter referred to as "its Sites"), cookies (hereinafter referred to as "cookies") are deposited on your computer. These cookies are used to improve your browsing experience on our Sites and their content.

What information is gathered from witnesses?

Cookies may collect personal information such as your IP address, as well as information that does not allow you to be identified, such as your language preferences, your browsing time and frequency of use, the pages you visit or the categories of advertisements you see.

Can I refuse or manage the witnesses used by the Fonds?

You will have the right to refuse cookies or set your cookie preferences upon entering the Sites and at any time thereafter by using the "" tool. You can also modify your choices regarding cookies by adjusting your browser settings. Refusal of functional cookies may result in inconvenience to your browsing experience (e.g., difficulties with registration, connection, or display).

What categories of witnesses are used by the Fonds and their purposes?

The Fonds uses different types of cookies.

    • Strictly necessary cookies: These cookies are essential to the proper operation of the Sites and cannot be deactivated. They are necessary to properly respond to actions you perform on its Sites, such as logging in, personalizing your privacy preferences, or filling out forms. You can set your browser to notify you when you receive a cookie or to block cookies, but some parts of our Sites may not function properly without them. These witnesses do not store any personal identification information.
    • Performance cookies: These cookies enable us to measure the performance of our Sites in order to improve the online services we offer. They show the Fonds, the most and least visited pages, the number of visitors, the sources of traffic and the way visitors navigate on its Sites. All information collected by these cookies is aggregated. If you refuse these cookies, the Fonds will not be informed of your visit to its Sites.
    • Marketing witnesses: These cookies are used to inform the Fonds of your online preferences and to present targeted advertisements. They may be set up on our Sites by our advertising partners to personalize the ads you see on other websites. These cookies do not directly store your personal data but are based on the unique identification of your browser and Internet device. If you do not allow these witnesses, you will continue to see advertisements, but they will not be customized according to your interests.

7. Under what conditions can we collect, use, and disclose your personal information?

Before collecting, using, and disclosing your personal information, the Fonds obtains your consent in accordance with the applicable requirements, unless an exception is provided for in the law (for example, in the context of penal or criminal proceedings), considering the sensitivity of the personal information to be collected and the uses to be made.

8. When and how can you withdraw your consent?

You may withdraw your consent to the use of your personal information by the Fonds for purposes that are not essential to the management and administration of your products and services, such as communicating targeted advertising and surveys, customize your experience, generating statistics, or analyzing your data. If you so choose, the Fonds will stop using them for these purposes.

It will generally not be possible to withdraw your consent to the use of your personal information for the management and administration of our products and services without terminating your contract[3].

You may change or withdraw your consent to the use of your personal information at any time by accessing your profil, under My consents section in your online account or by contacting Saving Services.

9. To whom is your personal information disclosed?

Your personal information is accessible only to Fonds' staff who require access in the course of their duties.

    • Financial institutions;
    • Our marketing, advertising and telephone service providers; Our technology service providers (e.g., application evaluation platform, analytical platforms);
    • Our data, server and system hosting service providers;
    • Recruitment firms;
    • Companies specializing in compliance or criminal and credit checks;
    • Government, tax and control authorities (the Access to Information Commission, self-regulatory organizations, securities regulators, the Financial Transactions and Reports Analysis Centre of Canada, public investigative or law enforcement agencies, including criminal and penal prosecuting authorities) and any other persons authorized by law to obtain them;

These third parties are bound by contracts that contain restrictions on the handling of your personal information and measures to protect your personal information.

10. How do we keep your personal information and for how long?

The Fonds uses systems and technology service providers to ensure the secure retention of your personal information to maintain its confidentiality. Your personal information is generally kept in Quebec. However, it is possible that the disclosure of personal information to certain technology solution providers could result in their transfer outside Quebec. In such cases, the Fonds first validates the privacy laws and practices applicable in the jurisdiction concerned and ensures that your personal information is adequately protected.

The Fonds keeps your personal information for as long as necessary for the purposes for which it was collected and within the applicable retention periods. When it is no longer necessary to keep your personal information, the Fonds will destroy or anonymize it. Destruction or anonymization is carried out securely.

11. How do we ensure the protection and security of your personal information?

The Fonds applies security measures proportionate to the sensitivity of your personal information. These measures protect your personal information and reduce the risk of unauthorized loss or theft, access, disclosure, and use.

    1. Administrative measures, such as the implementation of a framework to protect the Fonds' information assets, including your personal information, based on recognized standards, ongoing verification of security threats, and recurring privacy training and awareness activities for the Fonds' employees.
    2. Physical measures, such as restricting access to the Fonds' premises and implementing passwords or double-factor authentication mechanisms to access the Fonds' computer equipment, systems and internet networks.
    3. Technical measures, such as restricting access to your personal information to only those people who need it to perform their duties, setting up alerts in the event of suspicious events and securely encrypting communications.

While the Fonds employs a multitude of security measures to adequately protect your personal information and minimize the risks of breach to a minimum level, there is always a risk, and we cannot provide 100 % assurance that your personal information will not be breached in the event of a breach of our security measures. If you have reason to believe that personal information has been compromised, please contact the Office of the Chief Privacy Officer as indicated in question 14.

12. What are your rights with respect to your personal information?

The Fonds respects your legal rights to your personal information and therefore has procedures in place to process the following requests:

Accessing and correcting your personal information: You will be able to view, verify the accuracy of, and change, any personal information that the Fonds has collected about you, subject to statutory exceptions. Requests for access and rectification are free of charge. A reasonable fee may be charged for the transcription, reproduction, or transmission of your personal information. Your request for access or rectification should be forwarded to the office of the Chief Privacy Officer at the coordinates found in question 14 and will be processed no later than thirty (30) days following the date of receipt of your written request to the Fonds.

Automated processing: If the Fonds implements a decision-making process that is based exclusively on automated processing (without human intervention) of personal information, for example, a process that has a specific effect on an individual (cancellation of a contract, eligibility for employment) and that relies solely on an algorithm, you will be informed of the fact that you are the subject of such a process, of the decision that has been made and of your right to make representations with respect to that decision. You can also be informed of the following on request:

  1. Personal information used to make this decision;
  2. Reasons for this Decision;
  3. Your right to have the personal information used to make this decision corrected.

13. What if I have a question or want to file a complaint about my personal information?

Any questions about your personal information or complaints arising from non-compliance with the principles set out in the Notice should be directed to the office of the Chief Privacy Officer, whose contact information can be found in question 14.

15. Can this notice be amended and if so, how can I read it?

The Fonds may periodically change the content of this Notice. If applicable, a notice will be posted on the Fonds' websites and in our communication tools.
