The Fonds de solidarité FTQ would like to offer you its "Fonds FTQ online" service, subject to the terms and conditions stipulated herein. In exchange, you agree to comply with the terms and conditions of this Agreement, of our Privacy Policy as well as with the instructions that will soon be available on the Fonds website. Use of the "Fonds FTQ online" service indicates your acceptance of the terms, conditions and instructions, as well as any modifications thereto that may be made when you next use this site. If you do not agree to these conditions, do not use this service. 

1. Definitions of terms

a) Agreement: means the current conditions of use for the "Fonds FTQ online" service;

b) Fonds: means the Fonds de solidarité FTQ;

c) Password: means the confidential code you have selected, which belongs to you, for which you are responsible and which allows you to perform operations when you use the Services;

d) PSN: means the Personal Shareholder Number. This number is assigned by the Fonds and is exclusive to each Fonds shareholder. This number is found on all correspondence the Fonds sends you. It is your identification number;

e) Services: means all the services offered by the "Fonds FTQ online";

f) User: means the shareholder, the applicant who is about to become a shareholder or the person contributing to a spousal RRSP who uses the Services. The User is bound by the Agreement;

g) We, Our: means the Fonds individually and collectively;

h) h. You, Your: means the User of the "Fonds FTQ online".

2. Instructions 

When you use the Services, read and follow the instructions provided either through notices, brochures and guides, directly on the Fonds’ website or by mail. These instructions, which are also available at our offices, may be amended by the Fonds at any time, without notice or formality. We invite you to consult them regularly.

3. Legal consequences

Each operation performed through the Services, your Password and your Personal Shareholder Number (PSN) has the same legal value and the same legal consequences as if it had been carried out in accordance with a written instruction, on paper medium, and signed in your hand.

4. User representations and warranties

a) Protecting the confidentiality of your Password

You acknowledge that you are personally responsible for protecting the confidentiality of your Password and for ensuring that you are its sole User. You also acknowledge that your Password is reserved for your exclusive use and that the Fonds does not have access to it. You also undertake not to disclose your Password to anyone whomsoever and to keep it separate from other information you receive or already possess concerning the Services.

You release the Fonds from any liability and undertake to indemnify and hold the Fonds harmless against the unauthorized use of the Services by any other person using your Password.

b) Prohibited access and fraudulent use

You undertake not to try to enter restricted access areas of the Fonds’ computer system and use unauthorized functions.

 

 You undertake not to use the Services illegally, fraudulently, illicitly or in a manner that may jeopardize the security, integrity and efficiency of the Services.

c) Service interruption

You acknowledge that the Fonds may, without prior notice, temporarily or permanently interrupt your access to the Services by deactivating your Password if the Fonds has reason to believe that you are using the Services to gain unauthorized access to its other systems or information or that you are using the Services in any other manner deemed inappropriate by the Fonds.

d) Property rights

You acknowledge that the content of the site, namely, all the texts, data, graphics, photographs and images, software (including the calculator software) and all other trademarks, service marks and trade names used on the site as well as their selection and arrangement (collectively referred to as the "Content") are, unless otherwise notified, subject to intellectual property rights, including copyrights, trademarks and patents held by the Fonds or assigned to it. Unless otherwise expressly stated herein, no user license or content reproduction license is granted, and all intellectual property rights in this regard are expressly reserved.

You acknowledge that the names and logos of the Fonds used on this site may be trademarks (including registered trademarks) of the Fonds, and that such names and logos of the Fonds may not be copied, imitated or used in whole or in part, other than in accordance with the standards set out in the Standards Guide a copy of which you may request at the following address: comm@fondsftq.com. Other product and company names mentioned on this site may be trademarks of their respective owners.

Any other use of information posted on this site is strictly prohibited. You may not print or copy the HTML code or any other computer program used on the site. Unless otherwise notified, you may not reproduce, publish, transmit, distribute, execute, post, amend or create work derived from all or part of the Content or the site, nor sell, participate in the sale of all or part of the Content of the site, nor exploit in any manner whatsoever all or part of the Content on the site.

5. Password

The confidentiality of the Password is essential for the protection and security of the transactions you execute using the Services. Do not disclose it to anyone. The Fonds shall not assume any loss or damage that you may suffer in connection with disclosing your Password; you are fully responsible for your Password given that it is your property and known only by you. You may change your password at any time by clicking the "My Profile" header on this site.

6. Representations and warranties

You acknowledge that the Fonds does not warrant the availability, accuracy, completeness, relevance or use of the information it receives or that you receive through the Services a nd assumes no liability in this regard.

You hereby agree that the Services may be interrupted periodically to facilitate maintenance and update.

The Content, Services and information available on this site or through this site are provided "as is" and any representation, warranty and condition, whether express or implied or arising from the law or usage of trade, are excluded to the extent permitted by law.

The Fonds makes no representations and offers no warranty whatsoever as to the sites linked to this site, to the information that appears or to the third-party sources that are linked, and does not endorse them. The site may, from time to time, contain documents, data or information provided, posted or offered by third parties. You agree that the Fonds shall not be held liable in any manner whatsoever for the content of such third-party documents, data or information. 

Under no circumstances shall the Fonds, its directors, officers, employees or suppliers be held liable for any direct, indirect, incidental, punitive, consequential, special or other damages whatsoever (including but not limited to, damages to the enterprise, loss of profits, savings or revenues, business interruption, and loss of information, programs or other data on your information processing system) caused by the use or inability to use this site, its Content or the documents available on this site or through this site, or any information or functions of this site or any site linked or pertaining to it, whether or not the Fund had been notified of the possibility of such damages.

7. Indemnification

You undertake to indemnify and hold the Fonds harmless against all losses, damages and all expenses incurred by you or third parties, including, without limiting the generality of the foregoing, in connection with all proceedings or claims made by third parties and based in whole or in part on your failure to comply with and respect the terms, conditions and instructions stipulated in this Agreement and the instructions related thereto and forming an integral part thereof.

8. Force majeure

In case of force majeure, the Fonds shall not be held liable for losses, whether monetary, data or information, that you may suffer following the interruption of the Services.

9. Amendment of Services and conditions of use

You acknowledge that the Fonds may at any time modify, in whole or in part, the Services or conditions in connection with the Services, through a written notice posted at our offices, an announcement on its Website or notification sent by mail.

10. Confidentiality and security

The Fonds takes reasonable measures available to it to ensure the confidentiality of electronic data exchange, the security of transactions made through the Services, and the protection of privacy. You may obtain more information on this subject by consulting the "Privacy Policy" header. The Privacy Policy is an integral part of these conditions.

11. Dispute settlement

In case of a disagreement concerning an operation carried out through the Services, you shall notify us by communicating directly with one of the Fonds’ information agents or by clicking the following link Contact us.

12. Termination of Agreement

The Fonds reserves the right to terminate this Agreement at any time and interrupt the Services, in whole or in part, without notice or formality.

13. Miscellaneous

In this Agreement, use of the singular includes the plural and vice-versa, and references to any gender include all genders.

14. Governing law

This Agreement is governed by the laws in force in Québec and shall be interpreted in accordance with these laws, and each party consents to the jurisdiction of the courts of this province.
